Nonimmigrant Visa Interview Waiver Program Now Permanent

In January 2012, the Department of State introduced a Nonimmigrant Visa Interview Waiver Pilot Program. This pilot program allowed certain foreign visitors who attended interviews in conjunction with a prior visa application to renew their initial visas without having to undergo another interview. This pilot program is not permanent. Per modified 9 FAM 41.102, consular officers are now authorized to waive the interview for applicant who is:

  1. Under 14 years of age OR over 79 years of age;

  2. Seeking renewal of any nonimmigrant visa within 12 months of expiration of the initial visa in the same classification (i.e. same visa class and same category (principal or derivative));

  3. Seeking renewal of any nonimmigrant visa that expired between 12 and 48 months ago, with the exception of E, H, L, P, or R classification;

  4. First time Brazilian applicant in a visa class other than E, H, L, P, or R if he or she is younger than 16 years or 66 years or older and applying in the consular district of his or her normal residence; or

  5. A diplomat or official as set forth in 9 FAM 41.102 N3.2
