On May 2nd, 2016, USCIS stated that it had processed all H-1B cap petitions selected for FY 2017. USCIS will now start returning all H-1B petitions that were not selected in the lottery. USCIS requests that Petitioners only contact USCIS after they receive the Receipt Notices or the unselected petitions. USCIS is unable to project a definite date by when it will be returning all the unselected petitions. USCIS will make a formal announcement after all Receipt Notices are issued and unselected petitions are returned.
In order to balance the distribution of cases, Vermont Service Center will be transferring some H-1B cap subject petitions to California Service Center. The Petitioner will receive a notification in the mail that his or her case has been transferred. Moving forward, all future correspondence and requests for Premium Processing must be sent to the service center processing the petition.
