Possible Delays in the certification of LCAs for the 2010 H1B Quota

The Department of Labor (DOL) has indicated that they are planning to examine Labor Conditions Applications (LCAs) more closely this year. This would mean that the certification process of LCAs, which are filed online would go from the current few minutes to over a week or longer.  A Certified LCA is an essential component of the H1B visa application. Our advice to Employer would be to file their LCAs latest by March 01, 2009. This would give DOL sufficient time to certify the LCAs in order that Employers can meet the USCIS deadline of April 01, 2009 to file 2010 H1B Quota cases.

 

There is going to be a briefing by DOL in San Diego on February 04, 2009 on this topic and on using redesigned PERM and LCA Forms. We will post more details in regard to the filing of LCAs and PERM applications subsequent to February 04, 2009.
