Change in K-3 Processing Procedures by the Department of State
As of February 1st, 2010, in cases where USCIS has approved and sent both the
I-129F petition for a nonimmigrant K-3 visa and the I-130 petition for an IR-1
(CR-1) spouse of a US citizen visa to the National Visa Center (NVC), the need
for the K-3 visa ends as the Immigrant Visa application I-130 has been approved.
The K-3 visa was intended to facilitate the expeditious entry of US citizens’
spouses and children into the US. When both petitions are received by the NVC:
- The nonimmigrant K-3 visa will be administratively closed.
- The petitioner and Beneficiary will be contacted by NVC with
instructions to the processing of the IR-1 (RR-1) immigrant visa. For

If your I-130 petition and your I-129F for K-3 visa are not received by NVC
at the same time, then your I-129F for K-3 visa will be processed by NVC. |
