To qualify, an applicant must have served honorably for twelve (12) years in the Armed Services on active duty, and the service must be after October 15, 1978. This can include a person who has served for six years who is currently on active duty and has re-enlisted for an additional six more years. The applicant must have lawfully enlisted outside of the U.S. under a treaty or agreement in effect on the enactment date of the law.

 

An applicant’s spouse and children can also gain derivative status.
